Paid memberships and giveaway participation can coexist, but whether a particular promotion is lawful depends on how it is structured and which laws and platform rules apply. A paid membership can amount to consideration, which is why a members-only random drawing with no free route is the variant that carries real exposure. Adding a free alternate route is the conservative response rather than an automatic cure, tier weighting is unsettled, and platform policy may restrict the mechanic independently of the law. This is the question most creator-membership platforms eventually run into, and the answer depends less on whether members are entered than on what exists next to that.

Why a membership counts as payment

It does not help that the subscription buys other things as well — posts, a community, a badge. If paying is what places someone in a chance draw, the entrant paid for a place in the draw. That is consideration, and it is the element that separates a sweepstakes from an unlawful lottery. Platform policy tends to arrive at the same place independently: YouTube's contest policies say entrants may not be required to buy anything, including a paid channel membership.

How you market the tier matters too

If a paid tier is advertised primarily on the chances it confers, the thing being sold starts to look like chances, whatever the entry mechanics say underneath. Sell the membership on what members actually receive, and treat the entry as an incidental benefit that a non-member can also obtain for free.
